Ghana’s political landscape has been rocked by a landmark legal verdict that has sent shockwaves through the nation’s ongoing battle against illegal mining. Bernard Antwi Boasiako, popularly known as Chairman Wontumi, the influential Ashanti regional chairman of the opposition New Patriotic Party (NPP), has been sentenced to 20 years in prison with hard labour by the Accra High Court. The ruling, which also imposes a fine exceeding GH¢120,000, marks the first time a senior political figure has been jailed since President John Mahama assumed office, further intensifying the debate over galamsey—Ghana’s pervasive illegal mining industry that has devastated the environment, displaced communities, and sparked widespread public outrage.

A Landmark Judgment with Far-Reaching Implications

Justice Audrey Kocuvie-Tay delivered the verdict after a meticulous examination of evidence, concluding that Wontumi and his company, Akonta Mining Limited, had violated Ghana’s mining laws by unlawfully assigning mineral rights without ministerial approval. The case centered on the Samreboi concession in the Western Region, where prosecutors alleged that Wontumi’s firm had facilitated unlicensed mining operations, contributing to the environmental degradation that has plagued Ghana’s gold-rich regions.

The court found Wontumi guilty on multiple charges, including:
– Unlawful assignment of mineral rights without obtaining necessary approval from the Minister responsible for lands and natural resources.
– Facilitating unlicensed mining activities on land designated for legitimate mineral exploration.

Justice Kocuvie-Tay emphasized that the prosecution had overwhelmingly proven the allegations beyond reasonable doubt, particularly regarding the lack of ministerial approval—a critical legal requirement under Ghana’s mining regulations.

“The allegation was never contested. The accused admitted that no ministerial approval was received,”
Justice Kocuvie-Tay stated during the ruling.

The defense had argued that Henry Okum, a miner associated with the case, was merely engaged in land reclamation rather than large-scale illegal mining. However, the court dismissed this claim, citing direct evidence that confirmed ongoing mining activities on the concession.

The Broader Context: Galamsey’s Devastating Impact on Ghana

The conviction of Wontumi, a prominent opposition figure, has reignited national discussions about political interference in the fight against galamsey. Illegal mining has become one of Ghana’s most pressing environmental and economic crises, with devastating consequences:

  • Environmental Destruction: Thousands of hectares of forests, farmlands, and rivers have been degraded or destroyed by unregulated mining activities.
  • Water Pollution: Heavy metals and toxic chemicals from galamsey operations have contaminated major water bodies, threatening public health and aquatic ecosystems.
  • Agricultural Collapse: The cocoa industry, a cornerstone of Ghana’s economy, has suffered yield declines due to soil erosion and water scarcity caused by illegal mining.

Wontumi’s legal team, led by lawyer Bernard Owiredu, has vowed to appeal the verdict, calling it “mindboggling and unfair.”

The opposition New Patriotic Party (NPP) has rejected the notion of intimidation, with Henry Nana Boakye, the party’s national organizer, declaring:

“We are not going to be intimidated by this. The NPP will support Wontumi to appeal this political trial, and at the right time, the truth will be told. The party will not be intimidated.”

The conviction raises serious questions about whether the Mahama administration will now target other politically connected figures involved in illegal mining. With public pressure mounting for unbiased enforcement, the ruling could signal a shift in the government’s approach—or it may be seen as a politically motivated move to weaken opposition figures ahead of future elections.

Beyond its political implications, the case sets a precedent for future prosecutions against illegal mining operators. The Minerals Commission, which played a key role in presenting evidence, has strengthened its position in combating galamsey, though critics argue that enforcement remains inconsistent.

Environmental groups have welcomed the verdict as a step toward accountability, but they warn that systemic changes—such as stricter licensing, better monitoring, and community involvement—are still needed to sustainably curb illegal mining.

As Wontumi prepares to serve his 20-year sentence, the case has exposed deep divisions in Ghana’s political and legal landscape. While the opposition rejects the ruling as politically motivated, the government must now balance justice with public expectations—especially as illegal mining continues to undermine Ghana’s economic and environmental stability.
