Economic Policy Analyst, Sennyo Hosi, has called for a broader understanding of Ghana’s constitution, advising against its over-legislation.

According to him, the constitution is not a legal doctrine but a direct reflection of the will of the citizens.

“This is a very straightforward matter. You should understand one thing; don’t over-legalise the constitution. The constitution is not purely procedural jurisprudence; it is a pure reflection of the will of the people at any point in time,” he said. This was contained in a video shared on X by TV3 on October 26, 2024.

He explained that over-legalisation or strictly procedural interpretations overlook the essence, urging Ghanaians to view it as an embodiment of their aspirations and values.

Senyo also encouraged Ghanaians to revisit cases like Tuffour vs. Attorney General, citing Justice E.N. Sowah’s ruling.

He stated, “Go and read Tuffour versus Attorney General, and read the ruling of Justice E.N. Sowah. This is what Justice Sowah said:

“A written constitution such as ours is not an ordinary act of parliament; it embodies the will of the people. It mirrors their history and therefore needs to be regarded as a landmark in the people’s search for progress. More importantly, it contains their aspirations and hope for a better and fuller life.’

Senyo further said, “That constitution was not just crafted out of some legalistic engagement; it came from an engagement with the people. This is one of the most functional constitutions we have had because it was created by a consultative assembly. Hairdressers were part of those who did this thing; you didn’t need a legal certificate to be there. Everybody should find ownership of the constitution and speak about the representation therein.”
