Martin Kpebu and Gifty Oware-Mensah
Private legal practitioner Martin Kpebu has criticised the National Investigation Bureau (NIB) over the alleged detention of Ghana Football Association (GFA) Executive Council Member Gifty Oware-Mensah.
He stated that the NIB’s detention of the former Deputy Director of the National Service Authority (NSA) beyond 48 hours was a clear violation of the law, as they were required to take her to court within the stipulated time.
The member of the Operation Recover All Loot (ORAL) committee called on the NIB to operate within the law as they planned to go to court after the 48-hour period.
“I hear Gifty Oware has been arrested. We want to remind the NIB that 48 hours is 48 hours. The Supreme Court has been very clear. If you want to detain her beyond 48 hours, please go to court. So, even on Sunday, the court can still sit if so demanded. So, please, NIB, let’s do the needful.
“Per Article 14, Clause 3, if you arrest somebody, whether suspect or the person is accused at that time, and there are differences. And you want to detain the person beyond 48 hours, then make sure that you go to court within that time,” he said on TV3’s Key Points program.
Kpebu noted that he would be willing to represent Oware in court if she decides to take legal action against the NIB.
“If something happens and you don’t find the court early enough, causing the detention to exceed the legal limit, it constitutes a breach of the law. Gifty Oware can sue you. And I’ll be happy to represent her once it exceeds 48 hours,” he added.
This comes after reports emerged that the GFA ExCo member had been detained by the NIB on March 7, 2025, in connection with an alleged payroll fraud at the NSA.
Her arrest is part of an ongoing investigation into a ghost-name scandal that has drawn national attention.
However, GhanaWeb sources indicate that Gifty Oware-Mensah was interrogated and not detained, as claimed by some reports.
