According to reports from GhanaWeb, Kwaku Ansah-Asare, a former Director of the Ghana School of Law, has linked the recent controversy over the petitions for the removal of Chief Justice Gertrude Araba Sackey Torkornoo to actions taken by former President Nana Akufo-Addo.
During an interview on Morning Starr, Ansah-Asare shared his view that the former president should have avoided making a decision on the Chief Justice’s petition before leaving office.
He noted that it would have been preferable for the matter to be left for the new administration to handle, but that did not happen.
However, he acknowledged that if the former president acted within constitutional limits, his decision remains valid and cannot be overturned by the current administration.
He emphasized that in such a case, the Council of State would have to advise the president that the matter is settled.
Conversely, he argued that if due constitutional processes were not followed, President John Mahama has the authority to revisit the issue.
He added that he anticipated the decision would lead to further complications, and the current situation confirms those concerns.
