Member of Parliament for Akwatia, Ernest Kumi
The Supreme Court is scheduled to deliver a judgment on an application seeking to overturn an interim injunction that was issued against the swearing-in of Ernest Kumi, the Member of Parliament for Akwatia on April 30, 2025.
The injunction filed by Ernest Kumi is praying the apex court to quash the injunction and prevent the High Court from proceeding with further hearings of the case, citinewsroom.com reported.
The lawmaker was barred by the Koforidua High Court from swearing himself in as a Member of Parliament on January 6, 2025, due to a dispute about the Akwatia parliamentary seat. However, he defied the court order and participated in the ceremony, which led to him being cited for contempt by the court.
The legal team of Ernest Kumi, led by Gary Nimako Marfo, argues that the High Court’s ruling was erroneous when it granted the injunction. They contend that the court did not have jurisdiction over the matter.
According to the legal team, the injunction originated from an election petition filed by NDC parliamentary candidate Henry Boakye on December 31, 2024.
However, they argue that under the electoral laws, such petitions can only be filed within 21 days of the official gazette and publication of election results. They contend that the gazette was issued on January 6, 2025, making the petition premature.
Henry Boakye, the 2024 NDC parliamentary candidate legal team opposed the claim by Kumi’s lawyers, stating that the Electoral Commission (EC) had gazette the results earlier, on December 24, 2024.
They added that they had the original gazette documents and that Kumi’s version of the gazette documents were inaccurate.
